Accepted the first, the second one isn't really spamming and even if his mic isn't that good.
I don't think a mute is deserved here. Next time he's using his mic, just try to warn him about it so he can maybe do something to improve it
If he doesn't want to improve it or go through chat instead, call for an amdin or make a report!
