This will probably be one of my last, if not the last comments on this issue, which attempts to summarise the case and bring it to an end.
On the 25th October 2017, I had been joking with players on the servers with binds and referred to a cheat which spams text that is infamously known in the community, unknowing to the consequence that it would lead to. Without warning, I had received a one day ban for my actions and haven’t played on any of the Panda-Community Servers or sent messages on their forum. On the 12th November 2017, I had tried to connect to the server, only to find that I had been banned, and was banned permanently for the same event on Sourcebans.
After making the initial appeal,
@iceviet responded that he had “warned you for that and give you 1 day.
@Patmosphere told me about this and he told me about the cheating…. So i made it a perma for that because it is on the same levels as people having hacks.”
I had then confronted
@iceviet about him not giving a warning and that he was “taking advice from a donator.” I proceeded to ask him for “a chat log link to prove it and I also believe that
@Kevin should take a look at this,”
I had been confronted by other members of the community, specifically
@Patmosphere and
@Le Captain Pootis, as they believed and/or still believe that what I did was intentional.
I gave replies, which reinforced my point of no warning being issued, and me not knowing that mentioning the phrase of the cheat, which spams text that is infamously known in the community, that I had been deceived by
@Patmosphere who stated to “repeat that bloxi”, and I had been unaware of the consequences that it would lead me to. I also clarified that these two bans are relating to the same incident.
@Patmosphere then confirmed on behalf of
@iceviet, that no warnings had been issued due to the ban being issued through sourcemods.
I still insisted, and do now, that
@Kevin should take a look at this and make a final verdict, as these rules may have implications for other players, and that I had “no will to carry on with nonsensical discussions with someone who has no credentials”.
@iceviet then confirmed that he “didn’t warn you because to was all in source”
@Zushikikato Wolfeh then insisted that “you deserve a perma ban” and decided to insult with “**** off with your cheating ****” As an admin, after checking all the server rules myself, he broke Panda-Community’s own chat rules and sets a bad example for others.
After several comments exchanged between
@TBotV63 and @Zushikikiato Wolfeh, I decided to state to @Zushikikiato Wolfeh that “There’s a difference in making a reference to it, and to giving direct link to get it”. I had also mentioned “that I had not received a warning that even mentioning the bind is bannable” and finally pointed out that in the rules in the forums “a generic description of what “advertising” is.” had been given, and that “This is prone to people having their own interpretations of the rules, which is why I believe that the ban is unjust. I would also like to mention that perhaps, the rules section should be updated, to prevent these incidents from occurring again.”
@Zushikikato Wolfeh then indirectly confirms the point that I had made in which, different assumptions about the meaning of the rules will be made, by mentioning “common sense to me” and doesn’t mention anything about the rules explicitly mentioning that it is against the rules to even mention a cheat.
@Zeprus then makes a statement of “why in the world it should be a permanent ban when every other advertisement is punished with a temporary silence.
Given we actually consider it advertising, I don't believe simply writing the slogan of something in a context where people aren't actually talking about the product is advertising.”
From the events that have occurred I can make a final conclusion, that the ban is unjust due to several reasons which will be listed here, checked with the official Panda-Community rules:
1) No warning given, first admin abuse
2) Fooled into repeating a phrase, unknowing of the consequences
3)
@iceviet was unaware of the rules while issuing the ban as he mentions that he later discussed the rules with
@Patmosphere and issued a permanent ban, which suggests that he has poor administrative skills, and is unfit for a position of administrator, second admin abuse
4) It is not mentioned that making a reference to cheats is “advertising” on the official rules and only a generic description on “advertising” is given, which is prone to different interpretations.
I hope for a speedy resolution to this problem, and whether my appeal is accepted or rejected, I would like to make a final request of updating the rules, to prevent this incident from happening to other poor players, and would kindly ask for
@Kevin to make a final verdict.
